1. Scope

These General Terms and Conditions apply to all contracts concluded between Durchstarten Consulting GmbH (hereinafter referred to as the “Consulting Firm”) and its customers (hereinafter referred to as the “Customer”), unless expressly agreed otherwise in writing.

2. Scope of services

The consulting company offers consulting services, workshops, training courses, and events in the field of management consulting. The specific scope of services is set out in the contract concluded between the client and the consulting company or in the order confirmation.

3. Conclusion of contract

A contract is concluded upon written confirmation of the offer by the consulting company or upon signing a written contract. Verbal agreements are only valid if they are confirmed in writing. E-mail is considered written form.

4. Fees and terms of payment

The amount of the fee and the terms of payment are agreed individually between the client and the consulting firm and are specified in the respective order confirmation or contract. Payment of the fee shall be made in accordance with the agreed terms of payment.

5. Liability

The consulting firm shall only be liable for damages resulting from gross negligence or intent. Any liability for indirect or consequential damage is excluded.

6. Confidentiality

The consulting firm undertakes to treat all information provided by the customer as confidential and not to disclose it to third parties, unless this has been expressly agreed in writing or is required by law.

7. Data protection

The consulting firm undertakes to comply with data protection regulations in accordance with the applicable legal provisions. Personal data will only be used for the purpose of fulfilling the contract and will not be passed on to third parties unless the client has given their express consent.

8. Final provisions

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from or in connection with this contract is the registered office of the consulting firm. Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to its meaning and purpose.

By commissioning the consulting firm, the customer agrees to these General Terms and Conditions.
